JUDGMENT / ORDER

Learned advocate for the petitioner has submitted that the appeal preferred on 24.07.2006 has yet not been disposed of, though the hearing is concluded in the year 2011 itself.
In view of this, the court is of the considered view that without going into the merits, it would be most appropriate to dispose of this petition with following direction namely:
The appellate Authority, before whom the Appeal is pending shall pass reasoned order on the Appeal dated 24.07.2006 filed by the petitioner and said be communicated to the petitioner, within a period of 4 weeks from the date of receipt of this order.
The petition is disposed of. It goes without saying that if the order is adverse, the petitioner will have at liberty by way of filing fresh petition on fresh cause of action. No costs. Direct service permitted.
