BETWEEN Nanak Singh Nishter ….Petitioners And Government of Andhra Pradesh, Rep. by its Home Secretary, Secretariat, Hyderabad and anr …Respondents.
HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 28250 OF 2009
ORDER:
Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.
This Writ Petition was filed to declare Memo No.44205/Arms/1997, dated 18.8.2007 as illegal.
It is represented by the learned Counsel for the petitioner that in the absence of required documents at the time of filing the Writ Petition, he sought for quashing of impugned memo dated 18.08.2007 and other consequential orders. Subsequently, he obtained required documents under the Right to Information Act and sought to place the same on record. He further submitted that the respondents gave assurance to the petitioner that they would look into the matter as and when he filed a fresh representation and in pursuance of the same, the petitioner submitted a fresh representation on 30.11.2012 and the same is pending consideration with the first respondent. In view of the same, the learned Counsel for the petitioner submits that ends of justice would be met if the respondents are directed to consider and dispose of the said representation.
In the circumstances, the first respondent is directed to consider the representation of the petitioner dated 30.11.2012 and ignoring the impugned memo dated 18.08.2007, pass appropriate orders thereon, in accordance with law, within a period of six months from the date of receipt of a coy of this order.
Subject to the above direction, the Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
