Heard Mr. Suthar, learned advocate for the petitioner and it is submitted that while considering the application under Section 125 of the Code of Criminal Procedure, 1973, learned Principal Judge, Family Court, committed error to the extent that physical and mental cruelty against the petitioner is not proved and further no sufficient ground or reason appears for the petitioner for not staying with her husband.

Rule returnable on 9.5.2012.
