Heard learned counsel for the petitioner and learned A.G.A. for the State.
The instant habeas corpus writ petition has been filed by the corpus through her friend Kajeri Patel stating therein that the corpus is being illegally detained by respondent no.6, who is her father and natural guardian.
It is not disputed that the corpus is 28 years of age and if the petitioner no.2 is really concerned about the welfare of her friend (corpus), then she is at liberty to move an application under Section 98 Cr.P.C. before appropriate authority for issuance of search warrant against the respondent no.6.
In view of the aforesaid, the instant habeas corpus writ petition is misconceived and the same is, accordingly, dismissed.
