Heard Sri Anubhav Chandra, learned counsel for the petitioner and Sri Vijay Raj Pal, learned counsel, who has put in appearance by filing his appearance slip on behalf of the respondent nos. 1 and 2.
Learned counsel for the petitioner submits that the petitioner had earlier applied for issuance of passport in the year 2010, but his application was returned on the ground that there are certain short coming in the application and also with the suggestion that he may file a fresh application on a new proforma. The petitioner again filed an application in the year 2013 and the same was again returned due to some short coming and the petitioner was required to furnish certain other information, but for that time the petitioner changed his plan for going abroad and therefore, he did not do so. In the year 2018 the petitioner again applied for issuance of passport in the changed/new proforma, but this time his application has not been considered on the ground that he had not disclosed that he had earlier filed application for issuance of passport.
Learned counsel for the petitioner further submits that the petitioner has not disclosed his earlier application on the ground that earlier he was required to file a fresh application on new proforma, which he never done.
Be that as it may, since the petitioner had applied for issuance of passport and has furnished his explanation, the passport authority may consider the claim of the petitioner and pass appropriate order, in accordance with law, as far as possible within a period of one month from the date a certified copy of this order is presented before it.
With the aforesaid observation, the writ petition is disposed of. Order Date :- 30.11.2018 Lbm/-
