Nallusamy Reddiyar vs The District Revenue Officer

Madras High Court|05 September, 2017

JUDGMENT / ORDER

The present writ petition is filed for a direction to the respondents to grant correct UDR Patta to the petitioner by considering the petitioner's representation dated 02.08.2017.
2.Mr.G.Muthukannan, learned Government Advocate takes notice for the respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself.
3.The petitioner would claim that he is absolute owner of the property to an extent of 6 acres and 20 cents in S.No.317/2 situated at Sathyamangalam Village, Kulithalai Taluk. It is an ancestor property. However, in the UDR Scheme, the land was wrongly classified as 'Arasu Kuttai Poramboke'. Hence, the petitioner sent a representation to correct the mistake. Since no action was taken, the present writ petition.
4.The learned Government Advocate, on instructions, would submit that the representation given by the petitioner to the first respondent is now forwarded to the third respondent for necessary action and it is further submitted that any mistake crept in the UDR Scheme can be corrected only by the first respondent and if the petitioner gives a fresh representation to the first respondent, he is ready to consider the same.
5.In view of the above submission and considering the limited scope of the prayer sought for by the petitioner, this Court, without going into the merits of the matter, directs the petitioner to give fresh representation to the first respondent by enclosing a copy of this order within a period of two weeks from the date of receipt of a copy of this order. On such compliance, the first respondent shall consider the same and pass appropriate orders on merits and in accordance with law, after providing opportunity to all necessary parties, within a period of twelve weeks therefrom.
6.With the above direction, this Writ Petition stands disposed of. No costs.
To:
1.The District Revenue Officer, Karur.
2.The Revenue Divisional Officer, Kulithalai, Karur District.
3.The Tahsildar, Kulithalai Taluk, Karur District.
