The complaint precisely in all these writ petitions is that the respondents are making attempts to dispossess the petitioners from the subject lands without any authority of law and in an arbitrary and illegal manner and in violation of the principles of natural justice.
While ordering Rule Nisi, this Court granted interim orders in all the matters and the orders are subsisting as on date.
This Court passed the interim order in all these writ petitions directing the respondents not to dispossess the petitioners from the lands in question without following the due process of law and this Court also observed that the said order would not preclude the respondents to take necessary steps in accordance with law for recovery of possession. The said orders granted by this Court in the year 2008 are still continuing as on date. No counter affidavits have been filed in these matters either in the direction of denying the averments in the writ affidavits or in the direction of justifying the impugned action. Therefore, this Court deems it appropriate, without going into the merits and demerits of the writ petitions, to dispose of the writ petitions by continuing the said orders.
For the aforesaid reasons, the writ petitions are disposed of directing the respondents not to dispossess the petitioners from the lands in question without following the due process of law. However, this order will not preclude the respondent from taking necessary steps in accordance with law for recovery of possession. As a As a sequel, the miscellaneous petitions, if any, shall stand disposed of. No order as to costs.
