ORDER:
This writ petition is filed feeling aggrieved by order dated 20.07.2009 in ROR Revision Petition No.1/2007 of respondent No.2.
A perusal of the record shows that the revision petition filed by respondents 5 and 6 against the grant of pattadar pass book and title deed in favour of the petitioner was allowed by respondent No.2 and the case was remanded to respondent No.4 for conducting fresh enquiry under the provisions of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (for short ‘the Act’), after giving sufficient opportunity to both the parties. In order to comply with the said order, respondent No.4 has issued a notice on 04.01.2014 fixing 08.01.2014 for enquiry. Feeling aggrieved by the said order of respondent No.2 and the consequential notice issued by respondent No.4, the petitioner filed this Writ Petition.
The petitioner has approached this Court nearly 4½ years after the passing of the remand order by respondent No.2. No satisfactory explanation has been assigned by the petitioner for approaching this Court after substantial lapse of time. The Writ Petition, thus, suffers from uncondonable laches. At any rate, while setting aside the pattadar pass book and title deed issued to the petitioner, respondent No.2 has remanded the case to respondent No.4 for fresh enquiry. Therefore, the said order cannot be said to have caused grave injustice to the petitioner.
In the light of the above facts, I do not find any reason to interfere with the impugned order of respondent No.2 at this far too belated stage.
The Writ Petition is accordingly dismissed.
As a sequel to disposal of the writ petition, W.P.M.P.No.1273 of 2014 filed by the petitioner for interim relief is disposed of as infructuous.
