Order: (per Hon’ble Sri Justice Sanjay Kumar) The petitioner challenges the notification in G.O. Ms. Nos.
10 and 11, Municipal Administration & Urban Development (Elec.II) Department, dated 6.1.2005, whereby, the erstwhile Kakinada Municipality area was declared as a larger urban area and as Kakinada Municipal Corporation without including the surrounding villages. He contends that the procedure prescribed in this regard has not been followed.
In the counter filed as long back as on 23.2.2005, the Additional Secretary to the Government, M.A. & U.D. Department, Andhra Pradesh stated that the issue of merging sixteen (16) surrounding Gram Panchayats into the Municipal Corporation of Kakinada was under active consideration. He also set out the reasons for the inclusion of the said Gram Panchayats in the Municipal Corporation.
In the light of the stand taken by the respondent-State, the writ petition is disposed of directing the Government of Andhra Pradesh, to take a decision, if not already taken, on the issue of merging sixteen (16) Gram Panchayats in the Municipal Corporation of Kakinada. This exercise shall be completed within eight weeks from the date of receipt of a copy of this order in the event, the decision has not been taken till date.
Pending miscellaneous petitions, if any, shall stand disposed of, in consequence. In the circumstances, there shall be no order as to costs.
