Heard learned counsel for parties.
Undisputedly the petitioner is being paid a provisional pension pending conclusion of criminal proceedings. The prayer in this petition is for release of full pensionary benefits including gratuity. The aforesaid prayer cannot possibly be countenanced bearing in mind the provisions made in Regulation 919A of the Civil Service Regulations as also the decision of the Full Bench in Shivagopal And Others v. State of U.P. And Others [ 2019(5) ADJ 441 (FB)].
In view of the aforesaid, the petition fails and shall stand dismissed.
