Heard learned counsel for the parties.
The present petition has been filed with the prayer for mandamus commanding the Collector, Bijnor to demarcate Plot No.83 area 0.665 Hectares situated in village Mohammadpur Ghari, Pargana- Badhapur, Tehsil Nagina, District Bijnor.
It is contended that the petitioner has got lease of the said land in the year 1999 and during the course of consolidation operations, the said land has been declared chak out being "Nala". The prayer of the petitioner is to include the said land in the chak of the petitioner by demarcation thereof.
For the assertions made in the present petition, it is noteworthy that the petitioner moved a representation before the District Magistrate. As per own contention of the petitioner, the consolidation operations in the village are going on. The grievances raised by the petitioner in the representation cannot be addressed by the District Magistrate. The petitioner can only approach the competent Consolidation Authority under the provisions of U.P. Consolidation of Holdings Act, 1953. The prayer of the petitioner to decide the representation is, therefore, found misconceived.
The writ petition is dismissed as such.
