JUDGMENT / ORDER

The applicant has preferred this application for grant of furlough leave to take treatment from outside as he is suffering from HIV Positive.
As per the jail report, when the applicant was released on temporary bail in the month of November-December, 2007, he did not surrender in time and later on arrested by police late by 606 days. Thereafter, he was not released on furlough or parole. He is in jail since eight years. As per the report of the Medical Officer, A.R.T.Center, P.D.U.Hospital, Rajkot dated 2.2.2012, the applicant is suffering from HIV Positive and treatment is going on.
Considering the fact that the applicant is in jail since eight years and his jail record is good and considering overall facts and circumstances, the applicant is granted parole leave for a period of fourteen (14) days, from the date of his release, on furnishing a personal bond of Rs.2,000/- (Rupees Two Thousand Only), on the usual terms and conditions and to the satisfaction of the jail authority and on completion of the period of parole, the applicant shall surrender in time before the jail authority.
With the aforesaid observation and direction, this application is partly allowed. Rule made absolute to the aforesaid extent.
