JUDGMENT / ORDER

Heard learned advocates appearing for the parties.
On 27.09.2011 notice was issued to the respondent-bank since no decision was taken with regard to claim of legal heirs of the deceased employee for ex gratia lump sum amount in lieu of payment on compensation ground as per scheme approved by the Executive Committee of the Central Board of respondent-Bank.
In answer to the above, on 31.10.2011 Chief Manager of respondent-bank has addressed communication to the petitioner seeking certain information and particulars and documents along with application so that claim towards ex gratia lump sum amount as per the term and condition of the scheme which in force with effect from 04.08.2005 can be considered. The said communication is ordered to be taken on record.
In view of the above, it is not in dispute that the above communication is received by the petitioner as per acknowledgment and endorsement placed on the record by respondent No.2, who is present in the court. Now, the petitioner can approach the competent authority of the bank with necessary particulars, information and documents in terms of the scheme of ex gratia payment and the bank, who upon receipt of such information, particulars and documents, as required shall pass order in accordance with law preferably within three months from the date of receipt of such details.
At this stage, no direction is necessary and the petition stands disposed of in the above terms. Notice stands discharges with no order as to costs.
