Heard learned counsel for the petitioner and Sri Arvind Srivastava for the respondent no. 2.
The petitioner has a remedy of approaching the Debt Recovery Tribunal, keeping in view the proceedings that have been undertaken under the SARFAESI Act, 2002. Consequently, we are not inclined to entertain the writ petition leaving it open to the petitioner to approach the Debt Recovery Tribunal for any appropriate orders including any interim order that may be required on the facts and circumstances of the case.
