Heard Sri Sachindra Mohan, learned counsel for the applicant.
This application has been filed by the wife of opposite party for transferring the Matrimonial Case No. 439 of 2019 ( Athar Mahmood Vs. Naima Moin Azmi) for Restitution of Conjugal Right pending in the Family Court, Bulandshahar to Varanasi on the ground of convenience as well as pendency of other cases at Varanasi.
The details of the case are mentioned in paragraph nos. 2 and 3 of the affidavit filed in support of the transfer application.
Office report of 28.11.2019 is that the notice was issued to the sole respondent by registered post fixing 1.10.2019 and the report is that the item has been delivered.
No one has put in appearance on behalf of the respondent nor any counter affidavit has been filed.
Considering the facts and circumstances of the case, this application is allowed and the aforesaid case No. 439 of 2019 is transferred from Bulandshahar to Varanasi.
