Heard learned counsel for the applicant, the learned A.G.A. and perused the record.
This bail application has been filed on behalf of the applicant involved in Case Crime No. 158 of 2018, under Sections 498A, 323, 504, 304 IPC, P.S. Qila, District Bareilly.
As per prosecution case, the deceased who is wife of the applicant alleged that the applicant used to torture her and she was subjected to beating; four children were born out of the wedlock; she died due to malnourishment; applicant and her in-laws used to starve the deceased, consequently, she succumbed to her ailments due to starvation; no postmortem examination was conducted; statement of the doctor who examined the deceased has substantiated the prosecution version; the deceased was suffering from serious malnourishment.
Learned A.G.A. opposed the prayer for bail and submits that it will not be in public interest in case, applicant is released on bail.
Considering the facts and circumstances of the case, I am not inclined to allow the bail application at this stage.
The bail application is, accordingly, rejected.
The trial Court is directed to expedite the trial and conclude the same expeditiously on day to day basis from the date of production of a certified copy of this order provided there is no other impediment.
Office is directed to send a certified copy of this order to the trial Court concerned for immediate compliance.
