Heard Sri Dinesh Pathak, learned counsel for petitioner, learned Standing Counsel for respondent No.1 and Sri Kamal Kesherwani holding brief of Sri Baleshwar Chaturvedi, learned counsel for respondent Nos. 2 and 3.
The petitioner in the writ petition is seeking direction upon the respondent No.3 to accept the electricity dues of Rs. 17,53,674/- as per notice dated 15.10.2018 in easy instalments.
In our view, this is a matter between the petitioner and respondent No.3- Executive Engineer. The petitioner should therefore, approach the respondent No.3- Executive Engineer and settle the terms of instalments to the satisfaction of the parties.
The writ petition is dismissed with liberty to the petitioner to file his representation before the respondent No.3- Executive Engineer (Prescribed Authority), Electricity Distribution Division- III, Southern Electricity Distribution Corporation Ltd. Lal Diggi District- Aligarh. If such an application is filed by the petitioner before the respondent No. 3- Executive Engineer within one week from today, the respondent No.3 shall consider the same and pass appropriate order in accordance with law within a period of one month thereafter.
It is made clear that the Court has not adjudicated the claim of the petitioner on merit.
