JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) Rule.
Ms.Shah, learned APP waives service of rule on behalf of the respondent-State.
We have heard party-in-person who is present before the Court. The party-in-person was enlarged on temporary bail for a period from 16.2.2012 to 27.2.2012 on the ground of marriage of his son. Pursuant to the said order, he has to surrender to the jail authority tomorrow i.e. on 28th February, 2012.
By way of the present application, the applicant has prayed that the time to surrender before the jail authority tomorrow may be extended by further period of 60 days since he now wants to take care of his grand daughter who has physical ailments. Ailments are to the effect that she does not have passage for stool, such defect is from birth. Secondly, parents of the girl child will be there, coupled with the fact that the son of the present convict for whose marriage the temporary bail is granted, can also take care of the situation.
In totality of the facts, we are not inclined to permit the applicant to surrender late to the jail authority and it is ordered that applicant-convict shall have to surrender before the jail authority in time i.e. on 28th February, 2012.
Application stands rejected. Rule discharged.
