Nagjiji vs State

High Court Of Gujarat|18 July, 2012

JUDGMENT / ORDER

The applicant/prisoner has taken-out this application for seeking correction qua his right to obtain furlough leave, which is denied to him on account of his past conduct of tempering the temporary bail and his being required to be brought by police upto his arrest. In light of these circumstances, this Court is of the considered view that no direction qua furlough is required to be issued. However, it goes without saying that on appropriate occasion if his presence is required out side the jail, the same is always be granted qua temporary bail or parole leave. As the appeal is pending, he can file application seeking parole leave, which could be considered on its own merits. In light of this, this application is rejected. The applicant/prisoner be informed accordingly.
