JUDGMENT / ORDER

Heard Mr. G. Ramakrishnan, learned advocate, for the applicants and it is submitted that with regard to the alleged transactions and payment etc. remedy of civil suit was available to the complainant instead the complaint is filed under Sections 406 and 420 of IPC.
In the above circumstances, it is submitted that the complaint impugned deserves to be quashed and set aside.
Considering the above aspects and further inquiry order by the learned Metropolitan Magistrate, Court No.9, Ahmedabad, is pending as per order of inquiry under Section 202 of Code of Criminal Procedure, 1973, I am inclined to stay impugned complaint in terms of para 4(c).
Notice returnable on 21.3.2012.
