The present civil application has been filed for condonation of delay of 139 days caused in filing the First Appeal under Section 5 of the Limitation Act on the grounds stated in the application.
Heard learned counsel, Mr.Hemant Shah for the respondent.
In the circumstances, in view of the grounds mentioned in the application, sufficient cause can be said to have been made out for condonation of the delay. Therefore, considering the guidelines laid down by the Hon'ble Apex Court with regard to the approach in such matters, the present civil application deserves to be allowed.
The delay is condoned. The application stands disposed of as allowed. Rule is made absolute.
First Appeal is ordered to be placed for admission hearing on 4th May, 2012.
