Heard learned counsel for the petitioner and learned Standing counsel for the State-respondents.
The petition has been filed seeking the following relief-
"i) issue a writ, order or direction in the nature of mandamus commanding the respondent no.2 Tehsildar, Tehsil Sadar, District Mau to decide the restoration application of petitioner dated 04.09.2018 in Case No.RST/05719 of 2018, computerized Case No.T201815510105719 (Parvati Vs. Ram Chandra) under Section 35 of U.P. Revenue Code, 2006 regarding land in dispute situated at Mauza, Deehtilak, Thakur and Pahdevajeet, Tehsil Sadar, District Mau, pending in the Court of Tehsildar, Sadar, Mau within stipulated period from command of this Hon'ble Court."
Petitioner is aggrieved on account of pendency of his recall application filed in August 2018 for recalling mutation order passed in favour of the respondent.
Under the circumstances, this writ petition is disposed of directing the respondent no.2 Tehsildar, Tehsil Sadar, District Mau to endeavour to decide the restoration application of the petitioner, expeditiously, preferably within a period of three months from the date a certified copy of this order is filed before him.
