Heard learned counsel for the petitioner and learned Standing Counsel for respondent nos.1 to 3 and Shri Saurabh Tiwari holding brief of Shri Sahab Tiwari for respondent no.4.
The grievance of the petitioner is that he has raised constructions over his own property, but the respondents are trying to demolish the staircase by claiming that the same is encroaching public land.
It appears that the petitioner has made a representation in that regard before the Sub Divisional Magistrate, Hathras which seems to be pending.
In view of the above, we deem it appropriate to dispose of this writ petition by giving liberty to the petitioner to file a fresh representation before the third respondent (Sub Divisional Magistrate, District, Hathras) annexing therewith property related documents and also copy of the previous representation made. If any such representation is filed, the third respondent (Sub Divisional Magistrate, District, Hathras) shall call for reports from the concerned officials and take appropriate decision thereon by a reasoned order, preferably, within a period of next three weeks.
The writ petition stands disposed off.
