JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) THURSDAY, THE FOURTH DAY OF SEPTEMBER TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.25855 of 2014 BETWEEN Nagella Bangaru Swamy.
AND ... PETITIONER The Government of Andhra Pradesh, Rep. by its Principal Secretary, Revenue Department, Secretariat, Hyderabad and two others.
...RESPONDENTS Counsel for the Petitioner: MR. VENKATESH KODUMURY Counsel for the Respondents: GP FOR REVENUE The Court made the following:
ORDER:
This writ petition is filed alleging inaction on the part of the third respondent in considering the representations of the petitioner dated 07.02.2005, 23.03.2006 and 27.03.2006.
2. Petitioner states that he purchased an extent of Ac.2.54 ½ cents of land in Sy.No.462 on 18.07.1985 and since then, he has been enjoying the said land. Petitioner, however, states that the revenue authorities, while recording the said land in the revenue record and granting pattadar pass books to him, granted pattadar pass books only for an extent of Ac.1.27 ¼ cents of land leaving the balance land. Petitioner, therefore, submitted representations, as referred to above, requiring respondents 2 and 3 to re- enquire and issue appropriate orders rectifying the pattadar pass books or issue fresh pattadar pass books for the balance extent.
3. Since the action required to be taken on the representations of the petitioner for granting pattadar pass books is already taken, as above, the said representations cannot be any more said to be pending. Further, if the petitioner seeks pattadar pass books with regard to the balance land, it is necessary for him to submit appropriate application under Form VI-A read with Rules 18 and 19 of the Rules framed under the A.P. Rights in Land and Pattadar Pass Books Act.
4. Petitioner also states that LAOP’s are pending before the Senior Civil Judge, Proddatur where it is essential for the petitioner to produce pattadar pass books and title deeds for the said entire extent of land and therefore, seeks grant of pattadar pass books for the balance land under directions of this Court.
5. Apparently, the petitioner has not moved this Court earlier and only after the said LAOP’s are coming up for trial, the petitioner has sought for the pattadar pass books with regard to the balance land. However, as noticed above, since the petitioner has not made appropriate application, he is granted liberty to submit application in the prescribed proforma and as and when the petitioner’s application is received by the third respondent, he shall look into the said request of the petitioner expeditiously and pass appropriate orders as early as possible.
The writ petition is disposed. As a sequel, miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
