Respondent Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to enlarge the petitioner/accused herein on anticipatory bail in the event of is arrest in connection with Crime No.6/2014 on the file of PS, Kothur, Mahaboobnagar District.
The petition coming on for hearing, upon perusing the petition and the Memo of grounds filed herein, and upon hearing the arguments of SRI B. SHIVA KUMAR, Advocate for the Petitioner and of the Public Prosecutor, for the Respondent, the Court made the following ORDER This Criminal Petition is filed under Section 438 Cr.P.C. seeking anticipatory bail to the petitioner–Accused in connection with Cr.No.6 of 2014 of P.S. Kothur, Mahabubnagar District, registered for the offence punishable under Section 34 (a) of A.P.Excise Act.
Heard the learned counsel for the petitioner and the learned Public Prosecutor for the Respondent-State.
The case of the prosecution is that 12 bottles of King Fisher Premium beers each 650 ml. and MC Diet Whisky bottles 180 m.l. each were seized from the house of the petitioner under panchanama and Crime No.6 of 2014 under Section 34 (a) of A.P.Excise Act, has been lodged.
Considering the fact that the petitioner is a LIC Development Officer and according to him that the liquor was kept in his house only for the purpose of family gathering, I am inclined to grant anticipatory bail to the petitioner.
Accordingly, the Criminal Petition is allowed and the petitioner/Accused shall be enlarged on bail in the event of his arrest on condition of his executing a personal bond of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties for a like sum each to the satisfaction of Station House Officer, PS, Kothur, Mahabubnagar District.
