HON’BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.18699 of 2008 ORDER:
In this case, the petitioner challenged the demand made by the 1st respondent relating to payment of stamp duty.
2. This Court by order dated 28.08.2008 directed the respondents not to insist upon payment of stamp duty at 5% for registration of lease deed pursuant to the demand by the 1st respondent, subject to the condition that the petitioner pays the deficit stamp duty payable under Article 31(a)(ii) of Schedule -1.A of the Indian Stamp Act, 1899.
3. It is represented by the learned counsel for the petitioner that the petitioner paid the deficit stamp duty as directed by this Court and the period of lease was also completed. Accordingly, nothing survives for consideration in the writ petition.
4. Recording the said submission of the learned counsel for the petitioner, this writ petition is dismissed as infructuous. Pending miscellaneous petitions in this writ petition, if any, shall stand dismissed in consequence. No order as to costs.
