JUDGMENT / ORDER

This Criminal Original Petition has been filed seeking a direction to the sixth respondent to conduct further investigation under Section 173(8) Cr.P.C after obtaining prior permission from the learned Judicial Magistrate, Denkanikottai and file further final report in Crime No.84 of 2012 before the committal Court.
2. It is the case of the petitioner that on 16.05.2012, he was attacked by a gang armed with Aruval and other dangerous weapons and he sustained severe injuries. In this regard, one Gopal S/o.Ramareddy lodged a complaint, pursuant to which, the respondent police registered a case in Crime No.84 of 2012 for the offences under Sections 341, 294(b) and 307 IPC against eight persons and after due investigation, filed a charge sheet, which was taken on file as PRC No.4 of 2013 by the learned Judicial Magistrate, Denkanikottai. The said case is pending for committal. While so, the petitioner came to know that the complainant Gopal is having acquaintance with the accused persons. Hence, he made a separate representation dated 11.03.2017 to all the respondents requesting to conduct further investigation under Section 173(8) Cr.P.C and file further final report in Cr.No.84 of 2012 culminated as PRC No.4/2013 on the file of the learned Judicial Magistrate, Denkanikottai. Finding no response on the said representation, the petitioner is before this Court with the above stated relief.
3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents.

Considering the facts and circumstances of the case, this Court directs the fifth respondent to consider the representation of the petitioner dated 11.03.2017 with regard to conduct of further investigation under Section 173(8) Cr.P.C and file further final report in Crime No.84 of 2012 culminated as PRC No.4/2013 pending on the file of the learned Judicial Magistrate, Denkanikottai, and proceed further in accordance with law. Such exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order.
5. This Criminal Original Petition is disposed of accordingly.
