The petitioner is seeking a direction to the respondent to pass final notification under Section 3 of the U.P. Municipalities Act, 1960 in relation to inclusion of certain area in Nagar Panchayat, Sahpau, Hathras.
The case of the petitioner is that a draft notification was issued by respondent no.1 on 12.12.2020 inviting objections against the proposal for inclusion of Revenue Village Sahpau Dehat (Nagla meva, Takiya, Nagla Badam, Nagla Sukhram) in Nagar Panchayat, Sahpau. A period of 15 days was stipulated under the said notification for filing objections. Although, the said period has expired long back, but no final notification has been issued till date.
Learned Standing Counsel very fairly states that in case the petitioner approaches respondent no.1, he will be apprised of the correct position.
Accordingly, we grant liberty to the petitioner to approach respondent no.1 with a representation and true attested copy of the instant order and, in which event, the respondent no.1 shall examine the grievance of the petitioner in light of the legal provisions and in case the objections, if any, received against draft notification dated 12.12.2020, have been decided, consequential action shall be taken without any further delay.
The petition stands disposed of accordingly.
