The prayer made in the instant petition is for issuing direction to the court below to decide the application under Order 7 Rule 11 C.P.C. before proceeding with the hearing of any other application.
Petitioners are defendants in Original Suit No.60 of 2019.
There is nothing on record to indicate that they made prayer before the court below for deciding their application under Order 7 Rule 11 C.P.C. before proceeding to take up any other matter.
Accordingly, liberty is granted to the petitioners to make formal application in that regard and in which event, the trial court shall take appropriate decision on the said application.
The petition stands disposed of accordingly.
