Heard Sri Vikrant Pandey, learned counsel for the petitioner and the learned Standing Counsel for the respondents no. 1 to 3.
The petitioner is seeking a direction to the respondents to remove the encroachment of respondents no. 4 to 7 from Gata no. 135 area 0.02 hectares and Gata no. 137 area 0.065 hectare situated in Village Rasoolpur Naugaja, Tehsil Swar, District Rampur.
The petition has been filed by Nagar Palika Parishad, Swar, Rampur through its Chairman. It has already submitted an application before the District Magistrate, Rampur on 16.3.2018, Annexure-2 to the writ petition, on which the District Magistrate has directed the SDM, Swar to enquire into the matter and take steps for removal of illegal encroachment.
No useful purpose would be served in keeping the matter pending.
The writ petition is, therefore, disposed of with a direction to the respondent no.3-Sub Divisional Magistrate, Swar, Rampur to examine the matter and take appropriate action, in accordance with law, within a period of two months from the date of receipt of a certified copy of this order in his office.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
