Heard learned counsel for the petitioner and learned Standing Counsel for the respondents No. 1 to 4.
The petitioner claims that he was organising weekly Painth over his Khasra No.44, situate in Mohalla Sogiya Bara, Sikandrabad, District Bulandshahr but presently he is not being allowed to do so.
Learned Standing Counsel states that the area where this land is situate is too narrow and there is possibility of any untoward incident, if Painth is allowed to be held on this land.
The suitability of the land for holding the Painth is a matter which is required to be considered and decided keeping in mind that the Painth was being organised on it for the last many years.
In view of above, we dispose of the writ petition with the direction to the respondent No.3 District Magistrate, Bulandshahr to consider the representation of the petitioner dated 07.04.2018 filed in this regard in accordance with law after giving hearing to the concerned stake holders most expeditiously, if possible, within a period of three months.
The Writ Petition is disposed of.
