JUDGMENT Ravi S. Dhavan and V.P. Goal, JJ.
1. The Nagar Pallka Parishad.
Hapur, through its Chairman has filed the present petition seeking redress against the actions of the Uttar Pradesh State Electricity Board. It is unfortunate that the respondent, U. P. State Electricity Board is not taking notice of the fact that the Nagar Palika Parishad, Hapur is an attribute of Local-Self Government. Today. Local-Self Government has received sanctity after the Constitution of India was amended and Chapter IX-A was inserted. The subject matter of this Chapter is : THE MUNICIPALITIES. The complaint of the Nagar Palika Parishad, Hapur is that the U. P.
State Electricity Board, without any authority, proposes to instal a heavy transformer over the land of Nagarpalika Parishad which has not been rented to the Board.
2. The U. P. State Electricity Board sought to have respect for the Local-Self Government, which exists in the Nagar Palika Parishad. Hapur. This exertion of power against Local-Self Government is unhealthy. It would be appropriate that the U. P. State Electricity Board sorts out its difference with the Nagar Palika Parishad. Hapur.
3. With the aforesaid observations, the record of this petition is consigned.
