Heard learned counsel for the petitioner.
The petitioner has filed present petition inter-alia with the following prayers :-
"A. to set-aside the impugned order dated 17.7.2014 (Annexure-7) passed by Additional District Judge, Court No.3, Pilibhit in Misc. Appeal No.19 of 2013, granting injunction in favour of plaintiffs.
B. to quash the entire proceedings of O.S. No.84 of 2012 filed by plaintiffs/respondents against the petitioner, pending in the Court of Civil Judge (Junior Division), Bisalpur, District Pilibhit."
After some arguments, counsel for the petitioner has confined his prayer in respect of prayer B.
In view of the order proposed to be passed, notices need not go to the private respondents.
It is argued by learned counsel for the petitioner that since the matter is pending consideration before the court below for a long time he is suffering irreparable loss.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the concerned court below to consider and decide the aforesaid suit in accordance with law expeditiously but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties if there is no legal impediment.
