Heard learned counsel for the petitioner and learned counsel for the respondents.
Admittedly against the award, pursuant to which, the recovery certificate dated 29.9.2018 has been issued against the petitioner is subject matter of challenge in Writ-C No. 24888 of 2018 (Nagar Nigam Kanpur Vs. Presiding Officer, Labour Court (4) Uttar Pradesh Kanpur and another) which is pending before this Court. In the said writ petition it is intimated by learned counsel for the respondents that no interim order has been granted.
The petitioner cannot maintain the present petition which is a consequential recovery issued pursuant to the award under challenge in the aforesaid writ petition. It is open for him to file a proper application in the pending petition.
The present petition is, accordingly, dismissed.
