… Respondents THE HON’BLE SHRI JUSTICE SANJAY KUMAR WRIT PETITION NO.22488 OF 2004 O R D E R This writ petition was filed challenging the orders dated 25.09.2004 issued by the Mandal Revenue Officer, Vatticherukuru. The beneficiary of the said orders was impleaded as the third respondent herein. By order dated 23.08.2010, this Court directed service of notice upon the said respondent with a default clause that the writ petition would stand dismissed against the said respondent in the event of failure. The said order was given effect to by the Registry owing to the failure of the petitioner. As matters stand, the writ petition already stands dismissed against the third respondent. As the said respondent was the beneficiary of the impugned order, the validity thereof cannot be decided in its absence.
The writ petition therefore fails on this short ground and is accordingly dismissed in its entirety. The interim order dated 21.12.2004 shall stand vacated. Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
