(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) After hearing the learned counsel appearing for the parties and after going through the explanation given in the application for condonation of delay, we are satisfied that sufficient cause has been made out for not preferring the appeal within the period of limitation.

We, therefore, condone the delay of 69 days in preferring the appeal.

The application is allowed accordingly. Rule made absolute. No costs.

The appeal be listed for admission hearing on January 31, 2012.
