Heard Sri Rakesh Pandey, learned counsel for the applicant and Sri Alok Kumar Shukla, learned Brief Holder for the State.
It has been contended by the learned counsel for the applicant that the applicant is an old and sick lady which has been falsely implicated in the present case and 120 gm. diazepam and other intoxicated articles are said to have been recovered from the possession of the applicant. The applicant has no criminal history with respect to the N.D.P.S. Act. The applicant is in jail since 14.2.2018.
Learned A.G.A. has vehemently opposed the prayer for bail and submitted that the intoxicated articles recovered is above the commercial quantity.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Nafeesa involved in Case Crime No. 34 of 2018 under Section 18, 27 of Drugs and Cosmetics Act, 1948, and 21, 22, 25 and 26 of N.D.P.S. Act and 275, 420 I.P.C., police station Galshaheed, District Moradabad.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within preferably a period of six months from the date of production of a certified copy of this order, if, there is no legal impediment.
