Heard Sri Satish Chandra Dubey, learned counsel for the petitioner, learned Standing Counsel for the State-respondent nos.1 and 2, and Sri Rajesh Kumar Sachan, learned counsel for the respondent no.3.
By means of this writ petition, the petitioner has prayed for quashing the impugned recovery citation dated 24.4.2019 issued by respondent no.2 for recovery of Rs.1,86,795/- plus other charges including the provisional assessment order dated 27.10.2018. Further prayer is made for a direction upon the respondents not to take any coercive steps against the petitioner in pursuance to the impugned recovery citation.
Copy of provisional assessment notice has been served to the learned counsel for the petitioner by the learned counsel for Power Corporation today in the Court.
The petitioner may submit his objection before the respondent- corporation within a week from today. The respondent- corporation may decide the objection of the petitioner within three weeks thereafter.
For a period of one month from today, no coercive action may be taken against the petitioner.
With the aforesaid observation, the writ petition stands disposed of.
A copy of the order may be given to Shri Rajesh Kumar Sachan, learned counsel for the Power Corporation within next 24 hours for communication and necessary compliance.
