JUDGMENT / ORDER

Petitioner is the 9th accused in Crime No.1465 of 2013 of Ernakulam Town North Police Station for the offences punishable under Sections 436, 427, 120B, 202 of the Indian Penal Code, Section 3(a) of the Explosive Substance Act and Section 3 read with Section 23(1-B) and (a) of the Arms Act, 1959, is in custody from 31.03.2014 and seeks bail. 2. The learned Public Prosecutor has opposed the application. It is submitted that on 21.12.2013 some of the accused threw bomb at the residential building of the de facto complainant causing damage to vehicles etc. An unlicensed revolver belonging to the 4th accused was recovered from the possession of the petitioner. Some of the accused are yet to be arrested.
3. The learned counsel submitted that the allegations are Bail Appl.No. 3787 of 2014 () 2 not true. Petitioner is in custody from 31.03.2014. It is also submitted that allegation against the petitioner is only under the Arms Act for alleged possession of the revolver belonging to the 4th accused. According to the learned counsel, the petitioner was not aware of antecedents of the 4th accused.

In the nature of allegations made against the petitioner and investigation required to be done, I am satisfied that the request for bail cannot be allowed at this stage as grant of bail might affect further investigation. I make it clear that if otherwise the petitioner is entitled to get statutory bail, this order will not stand in its way.
The application is dismissed without prejudice to the petitioner moving again after the investigation has progressed.
