The instant petition under Article 227 of the Constitution of India has been filed by the petitioner-landlord seeking a direction to the Prescribed Authority to decide P.A. Case No. 53 of 2013, expeditiously, within a specified time.
The petitioner has filed a release application under Section 21(1)(a) of U.P. Act No. 13 of 1972, which was registered as P.A. Case No. 53 of 2013. A perusal of the order sheet reveals that the tenant opposite party has appeared in the said proceedings long back, but despite several dates having been fixed for leading evidence by the tenant, the evidence has not been filed.
Under Rule 15(3) of the Rules framed under the Act, every application filed under Section 21 should as far as possible be decided within two months from the date of its presentation.
Having regard to the legislative intent and the facts of the case, the instant petition is disposed of by directing the Prescribed Authority to make all endeavour to conclude the proceedings of P.A. Case No. 53 of 2013 expeditiously, preferably within a period of six months from the date of production of certified copy of this order.
