The petitioner’s vehicle bearing registration No.TN-45- BD-8506 has been seized alleging extraction of ordinary earth in violation of the Minor Mineral Concession Rules. The petitioner submits that this was done based on a valid permit.
Considering the facts and circumstances, there shall be a direction to the respondent to release the vehicle to the petitioner on executing a simple bond. However, it is made clear that the release of the vehicle will not stand in the way of the authorities filing a complaint under the Mines and Minerals (Development & Regulation) Act, 1957, if so warranted.
The writ petition is disposed of as above.
