By means of present writ petition, the petitioner has challenged the validity of order dated 22.12.2016 passed by Sub Divisional Magistrate, Sadar, District Rampur and order dated 07.04.2018 passed by Additional Commissioner IInd (Administration), Moradabad Division, Moradabad.
Learned counsel for the petitioner submits that on the resolution of Land Management Committee of village Nagalia Aquil, Tehsil, District Rampur dated 20.06.1975 for regularization of the rights of petitioner, the name of petitioner has been entered upon in the revenue records and on the basis of the same, the petitioner is in possession over the land in dispute for more than 40 years period and as such, the name of petitioner cannot be expunged under the provision of 33/39 of L.R. Act 1901.
The matter requires consideration by this Court.
Learned Standing Counsel has accepted notice on behalf of State respondents.
All the respondents are accorded four weeks' time to file counter affidavit. The petitioner will have one week thereafter to file rejoinder affidavit. List thereafter.
Until the next date of listing, the status quo as of today shall be maintained by the parties qua the land in question.
