Heard learned counsel for the petitioner and learned Standing counsel for the State.
By means of present writ petition the petitioner has prayed for arrears of salary for the period 30.06.2016 to 17.11.2017.
Learned counsel for the petitioner contends that the petitioner was appointed as class IV employee in the Irrigation Department and while working at Afzalgarh Irrigation Block, Dhampur he was superannuated on 30.06.2016. It is further contended that the order of superannuation was thereafter cancelled by the Chief Engineer Irrigation Department, U.P. Lucknow on 12.10.2017.
Learned Standing counsel appears on behalf of respondent nos. 2, 3 and 4 states that the petitioner has already made a representation on 17.05.2018 claiming arrears of salary for the period 30.06.2016 to 17.11.2017 and the same may be considered and decided by the competent authority in accordance with law.
In view of the above, the petition is disposed of directing the respondent no. 4 to consider and decide the representation of the petitioner by reasoned and speaking order, expeditiously, preferably within a period of two months from the date of filing of certified copy of this order.
The writ petition is accordingly disposed of.
It is clarified that the Court has not considered the claim of the petitioner on merits.
