Order:
This Writ Petition is filed with the grievance that though the petitioner’s authorization in respect of the fair price shop of Kuruvalli Village, Alur Mandal, Kurnool District, is subsisting, respondent No.4 has not been releasing the stocks of essential commodities for the month of October, 2014, to him for distribution to the card holders.
Learned Assistant Government Pleader for Civil Supplies, on instructions, from the respondents submitted that the previous incumbent of the office of respondent No.4 has withheld the stocks and that the present incumbent has assumed the office a few days back, by which time the November quota was already released to another dealer. He has further submitted that he has instructed respondent No.4 to resume allotment of stocks to the petitioner’s fair price shop from the month of December, 2014, and that respondent No.4 will, accordingly, release the stocks in future.
Though this Court is thoroughly unhappy with the action of the previous incumbent of the office of respondent No.4, as he is no longer continuing in the said office, further action in this regard is dropped.
In view of the undertaking given by the learned Assistant Government Pleader on behalf of respondent No.4 that supply of the stocks of essential commodities to the petitioner’s fair price shop will be resumed from the month of December, 2014, the Writ Petition is closed by administering a caution to respondent No.4 not to withhold the stocks so long as the petitioner’s authorization remains in force.
As a sequel, WPMP.No.42225 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
