Heard learned counsel for the parties.
The petitioner has filed this writ petition alleging inaction on the part of the second respondent-Joint Collector in hearing and disposing of the revision petitions filed by him. It is evident from the papers filed along with the writ petition itself that the second respondent has granted stay of the orders of Revenue Divisional Officer as an interim measure in the said revision petitions by orders dated 26.9.2012 and the said revision petitions are said to be pending from 2012. However, there are 19 private party respondents and some of them are still not yet served. Obviously therefore, unless the private party respondents are served or given up, the revision petitions cannot be heard finally. Since the revision petitions are pending from 2012 for want of service of contesting respondents, it cannot be said that there is inaction on the part of the second respondent. Hence I do not see any reason to entertain the writ petition.
However, in the interest of justice, this writ petition is disposed of permitting the petitioner to take steps to serve all the unserved respondents in the said revision petitions and file proof of service before the second respondent who shall examine the service with respect to each of the respondents, take up the revision petitions and decide them expeditiously in accordance with law.
The writ petition is accordingly disposed of. Miscellaneous applications, if any, shall stand closed. No costs.
