JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) FRIDAY, THE SEVENTEENTH DAY OF OCTOBER TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.28644 of 2014 BETWEEN M/s.N.Venkata Lakshmamma AND ... PETITIONER The State of Andhra Pradesh, Rep. by its Principal Secretary (Department of Revenue), A.P. Secretariat Building, Hyderabad and others.
...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. Petitioner, who was the earlier cooking agency, filed the present writ petition questioning the proceedings of Tahsildar, dated 28.08.2014, wherein respondent No.5 was appointed as the cooking agency of M.P.P.S. Bheemagundam.
3. During the last date of hearing, it was noticed that the said impugned proceedings refers to earlier proceedings No.B/153/2014, dated 31.07.2014. Since the petitioner was not aware of the same, learned government pleader was required to get copy of the said proceedings. A copy of the said proceedings is produced, which shows that joint inspection was conducted by the Mandal Educational Officer and other related members and thereafter on finding serious irregularities, petitioner was removed as a cooking agency by passing an appropriate resolution.
4. Since the petitioner has not questioned the said order and has only questioned the consequential order, which is impugned in this writ petition, it is just and appropriate to dispose of the writ petition granting liberty to the petitioner, as sought for by the learned counsel for the petitioner, to question the said earlier proceedings, dated 31.07.2014, in accordance with law.
With the aforesaid liberty, writ petition is disposed of.
As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
