This petition under section 24 of the Code of Civil Procedure is filed by the petitioner-wife seeking transfer of O.P.No.314 of 2014 from the file of the Judge, Additional Family Court, City Civil Court, Hyderabad, to Senior Civil Judge’s Court, Amalapuram, East Godavari District.
Heard the learned counsel for the petitioner.
In spite of service of notice, none appears for the respondent.
Petitioner-wife seeks transfer of the case on the ground that though both the parties are residents of Amalapuram, the respondent herein filed the O.P. for grant of divorce at Hyderabad taking advantage of his Voter Identity Card. Further, the petitioner being the lady facing difficulty in traveling all the way from Amalapuram to Hyderabad to defend the O.P. filed by the respondent.
In Sumita Singh v Kumar Sanjay[1] the Hon’ble Supreme Court held that in matrimonial matters, convenience of the wife has to be taken into consideration.
Considering the above circumstances, this petition is allowed O.P.No.314 of 2014 is hereby withdrawn from the file of the Judge, Additional Family Court, City Civil Court, Hyderabad, and transferred to Senior Civil Judge’s Court, Amalapuram, East Godavari District, for disposal in accordance with law.
Miscellaneous petitions pending in this petition, if any, shall stand closed.
