ORDER:
This Contempt Case is filed alleging willful disobedience of order, dated 19.09.2013, in Writ Petition No.15067 of 2013.
By the above-mentioned order, this Court has directed respondent No.2 herein to undertake a thorough enquiry into the allegation that respondent Nos.7 to 45 in the Writ Petition are no other than the wives of journalists and cancel the assignments, if the said allegation is proved, besides initiating appropriate disciplinary action against the officers who are responsible for granting assignments to such ineligible persons. This Court has further directed payment of compensation to the petitioners in respect of Ac.0.25 cents of land in Survey No.101/3 of Akkarampalli Revenue Village, Tirupati Urban Mandal, Chittoor District, allotted to Tirupati Municipal Corporation, in case, the former succeed in getting ryotwari pattas in respect of the said land from respondent No.3 in the Writ Petition and a direction was given to the Joint Collector, Chittoor District-respondent No.3 in the Writ Petition, for expeditious disposal of the Claim Petition filed by the petitioners. The petitioners filed this Contempt Case alleging that the said directions have not been complied with.
Respondent No.1 filed a counter-affidavit, wherein it is, inter alia, stated that the Revenue Divisional Officer, Tirupati acted as an appellate authority and cancelled the house site pattas granted in Survey No.101/5 of Akkarampalli Village, vide proceedings in Roc.No.B/1028/2014, dated 01.04.2014 and the Tahsildar, Tirupati Urban, has addressed letter, vide Lr.No.Roc.B/781/2012, dated 02.04.2014, to the Divisional Engineer (Op), APSPDCL, Tirupati not to release any power connections to the house sites situated over the subject land and he has also addressed the Commissioner, Tirupati Municipal Corporation not to issue any house tax receipts in respect of the properties situated over the subject land. It is further stated that articles of charges were prepared for initiating disciplinary action against the then Tahsildar, Tirupati Urban-V.Nagarajuna Reddy and the same were sent to the Special Chief Secretary and Chief Commissioner of Land Administration, Hyderabad.
With regard to enquiry into the petitioners’ claim for grant of ryotwari pattas, the learned Government Pleader for Revenue (Andhra Area) submitted that the case was heard on several dates including on 07.06.2014, and the same stood posted to 21.06.2014, at the request of the learned counsel for the petitioners, and the case will be disposed of on merits shortly.
In the light of the above facts of the case, this Court is convinced that respondent No.1 has taken all steps for implementation of the above-mentioned order of this Court. Therefore, the Contempt Case is closed with liberty to the petitioners to avail appropriate remedies, if in future the respondents do not act with diligence in dealing with the subject land.
As a sequel to disposal of the Contempt Case, Application No.455 of 2014 is disposed of as infructuous.
