JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 11821 of 2003 Petitioner :- N.T.C. Mills Staff Association U.P. And Another Respondent :- Union Of India And Others Counsel for Petitioner :- Somesh Khare Counsel for Respondent :- S.C.,B.N. Singh,D. Awasthi,U.P. Singh
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press the writ petition. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs:
"(i) Issue a writ, order or direction in the nature of certiorari quashing the impugned order/communication dated 8.1.2003 passed by respondent No. 2.
(ii) Issue a writ, order or direction in the nature certiorari quashing the impugned communication/notice dated 27.1.2003 issued by the Officer on Special Duty, Lord Krishna Textile Mill, Saharanpur.
(iii) Issue a writ, order or direction of a suitable nature commanding the respondents not to coerce the petitioner/its members from accepting the MVRS scheme.
(iv) Issue a writ, order or direction of a suitable nature commanding the respondents not to interfere in the peaceful functioning of the members of the petitioners' association on their respective posts within a period to be specified by this Hon'ble Court.
(v) issue a writ, order or direction of a suitable nature calling for the records of the proceedings of closer as stated to have been held on 11.12.2002 by the Joint Secretary, Ministry of Labour, Government of India, New Delhi"
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting relief as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
