This writ petition is filed for a mandamus directing the respondents to consider the objections of the petitioner dated 25- 04-2014 and 28-04-2014 relating to the tender process in respect of Canteen in Ongole Bus Station, Prakasam District before finalizing the tenders.

The grievance of the petitioner is that in pursuance of the tender notification dated 20-03-2014 issued by the 2nd respondent calling for tenders for running of canteen in Ongole Bus Station, the petitioner submitted his tender with all credentials along with other two tenderers. It is stated that the tenders were scheduled to be opened and finalized on 09-04-2014, which is last date for receiving the tenders. But, the Tender Committee without finalizing the tenders on that day informed the petitioner and others that they will intimate the tenderers later about the date and finalization of the tenders, but the Tender Committee has accepted the tender of one N. Sreedhar Rao, who is not technically qualified, for which he filed objections on 25-04-2014 and 28-04-2014 to the Chairman of the Tender Committee regarding the acceptance of tender of one N. Sreedhar Rao, who is not technically qualified. But, without considering the said objections, the respondent authorities is going to allot the tender to Sri N. Sreedhar Rao. Aggrieved by the same, the present writ petition is filed.
3. Heard the learned counsel for the petitioner, who submits that without considering the objections filed by the petitioner, the respondent authorities is going to allot the tender to the unqualified tenderer.

On the other hand, the learned standing counsel for the respondents produced a copy of the decision of the Chairman of the Committee, which shows that the objections of the petitioner dated 25-04-2014 and 28-04-2014 are considered and then only the tender of Sri N. Sridha Rao, Managing Partner of M/s. Sandarshini Inn, who is the highest bidder, was accepted and awarded the contract to him vide proceedings No.02/122(103)/2014-RM(O), dated 23-06-2014.
Having due regard to the decision of the Tender Committee, it appears that the petitioner’s objections were considered and a decision was taken for awarding the contract to one N. Sridhar Rao.
In view of the above facts and circumstances, the only relief that can be granted to the petitioner is that the respondents are directed to communicate the decision of the Tender Committee as well as the proceedings No.02/122(103)/2014-RM(O), dated 23- 06-2014 to the petitioner and it is always open for the petitioner to avail appropriate remedies to challenge the decision of the Tender Committee, if he is advised to do so.
Accordingly, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
